Divorce can be a complicated, emotional process. You might have heard the term “grounds for divorce”. In the state of Mississippi, for a contested divorce to proceed, one or more of the following twelve causes must be met. These qualifications come from Mississippi Code §93-5-1.
- Natural impotence
- Adultery, except in cases where both parties conspired to commit adultery in order to procure a divorce
- Being sentenced to a penitentiary, and not receiving a pardon
- Willful and consistent abandonment for at least one year
- Habitual drunkenness
- Habitual drug usage
- Habitual abusive treatment
- If one party has a mental illness or disability that was not disclosed to the other party at the time of marriage
- Another, undisclosed marriage that predates the current pair’s marriage
- If the wife was pregnant by another person at the time of the marriage, and the husband was unaware of the pregnancy
- If the parties receiving the divorce are related to each other in a degree where marriage is prohibited by law
- Incurable mental illness
