What to Expect after an Arrest

An arrest is a frightening process.  If you or a loved one have recently experienced an arrest, then you are likely anxious and riddled with many questions about what will happen next.  Below we will outline the steps that could occur after an arrest in order to prepare you for what could happen.

It is important to note that each case of the criminal justice process will be different, but they will generally follow these steps.  After the initial arrest, the defendant will have an initial appearance before a judge, where a bond will be set.  Most cases, whether felonies or misdemeanors, begin in misdemeanor court such as Municipal or Justice Court. A probable cause hearing or Preliminary Hearing may take place to determine probable cause.

In felony cases where the judge has found probable cause for the arrest, the case will be bound over to the Circuit Court.  After the case is bound over, the case will be presented to a grand jury and the defendant will be formally indicted.  The defendant will then be served with an indictment, and they will receive a court date in Circuit Court to receive discovery and a plea offer.
